The Website www.paths.care is a site operated by Charlene Camilleri Duca trading as paths (hereinafter referred to as “We” or “Us”), with Our office located at 52 Triq Ġużè Ellul, Gwardamanġa, Malta. We pride ourselves in providing professional psychological services of the highest quality.

Use of the Site and Acceptance of Terms

Use of this site implies that you are 18 years old and older. Use of this site also implies that you confirm your acceptance of these Terms and that you agree to fully comply with them. Furthermore, you are also responsible for ensuring that all persons and/or users who access Our site through internet connection for which you are responsible are aware of the content of these Terms and of any other applicable policies or terms and conditions, and that they comply with them. If you do not agree to these Terms, you must not use Our site.

We recommend that you print a copy of these Terms for future reference.

Changes to the Terms and the Site

We reserve the right to occasionally amend the content of these Terms from time to time depending on the needs and exigences of the business or of the technical development of the website itself. The content of previous versions of these Terms would not apply if a newer version of the same would be in force at the time.

We may occasionally update and change Our site from time to time to reflect updated services availability, pricing or specifications, due to updates on Our services, or to reflect changes to Our services.

Certain services provided by Us are bespoke and tailor made to each of Our clients’ needs and requirements, so you are therefore urged to contact Us to discuss what sort of services would benefit and apply to your organisation before taking, or refraining from, any action on the basis of the content on Our site.

Although We make reasonable efforts to update the information on Our site, We make no representations, warranties or guarantees, whether express or implied, that the content on Our site is accurate, complete or up to date.

This website may include information and materials uploaded by other users of the site, including to bulletin boards and chat rooms. This information and these materials have not been verified or approved by us. The views expressed by other users on Our site do not represent Our views or values.

Our responsibility for loss or damage suffered by you

Whilst We do not exclude or limit in any way Our liability to you where it would be unlawful to do so, different limitations and exclusions of liability will apply to liability arising as a result of certain services which We may offer.

If you are a business user, We exclude all implied conditions, warranties, representations or other terms that may apply to Our site or any content on it. We furthermore exclude any and all liability for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with use of, or inability to use, Our site or use of or reliance on any content displayed on Our site.

In particular, We will not be liable for:
  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

If you are a consumer user, please note that We only provide Our site for domestic and private use. You agree not to use Our site for any commercial or business purposes, and We shall in no way be held liable to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. If defective digital content that We have supplied damages a device or digital content belonging to you and this is caused by Our failure to use reasonable care and skill, We will either repair the damage or compensate you. However, We will not be liable for damage that you could have avoided by following Our advice or recommendations, or for damage that was caused by your failure to correctly follow any instructions provided or to have in place the minimum system requirements as advised by us.

Uploading content to Our site

Whenever you make use of a feature that allows you to upload content to Our site, or to make contact with other users of Our site, you must comply with the content standards set out in Our Acceptable Use Policy. You warrant that any such contribution complies with such standards, and you will be liable to Us and indemnify Us for any breach of that warranty. This means you will be responsible for any loss or damage We suffer as a result of your breach of warranty.

Any content you upload to Our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant Us a limited licence to use, store and copy that content and to distribute and make it available to third parties.

We have the right to remove any posting you make on Our site if, in Our opinion, your post does not comply with the content standards set out in Our Acceptable Use Policy.

We do not guarantee that Our site will be secure or free from bugs or viruses. You are responsible for configuring your own information technology, computer programmes and platform to access Our site. You should use your own virus protection software.

You must not misuse Our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to Our site, the server on which Our site is stored or any server, computer or database connected to Our site. You must not attack Our site via a denial-of-service attack or a distributed denial-of service attack. We will report any such violation to the relevant law enforcement authorities and We will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use Our site will cease immediately.

If you wish to link to or make any use of content on Our site other than that set out above, please contact Us via the contact information set out above.
You may link to Our home page, provided you do so in a way that is fair and legal and does not damage Our reputation or take advantage of it. You must not establish a link to Our site in any website that is not owned by you.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on Our part where none exists.

Our site must not be framed on any other site, nor may you create a link to any part of Our site other than the home page.

Which country’s laws apply to any disputes?

Please note that these Terms, their subject matter and their formation (including any non-contractual disputes and claims) are governed by Maltese law.
Both you and Us agree that the Courts of Malta will have exclusive jurisdiction on any such matters.

p_ths is a registered trademark of Charlene Camilleri Duca. You are not permitted to use it without Our approval.

TherapyPacks Terms and Conditions

1. TherapyPacks come in bundles of 5 or 10 sessions. Prices of bundles:

  • 5 sessions – €270 – must be utilised within 3 months from date of purchase
  • 10 sessions – €520 – must be utilised within 6 months from date of purchase

2. Bundles are not transferable. This means they cannot be used by, or gifted to, anyone else but the person whose name is listed as the TherapyPacks bundle holder.

3. Bundles which are purchased for Couples Therapy and Family Therapy can only be used by members of the couple or family with one therapist. If members of a couple or family decide to take up individual therapy with another therapist, the bundle will only apply to sessions with the therapist originally referred and cannot be also used for the individual sessions with another therapist. Exceptions will be made if the original therapist is unable to see the client or family and the couple or family are referred to another therapist. After referral, the same conditions will apply.

4. Bundles are valid for a limited time period, as listed above. This means that the bundles will expire once the respective time period has elapsed. Any sessions not utilised within this period will be lost. This means that a refund will not be given for unused sessions. Start date commences on date of purchase of bundles.

5. Bundles are only valid for full price sessions (charged at €60) and not for sessions with trainee psychotherapists, reports or assessments.

6. Full payment needs to be made on purchase, via bank transfer, cash or credit card.

7. Management reserves the right to terminate or suspend the use of the bundles. Reasons for such are at the discretion of the clinic.

8. Refunds or extensions of time period within which bundles may be used is at the discretion of management and will only be granted in exceptional circumstances.

9. Management reserves the right to modify or replace the terms and conditions. In such circumstances, clients will be given adequate notice and time to adhere to such.

10. The clinic’s cancellation policy is applicable also to bundles. Late cancellations or no shows will result in the forfeit of a session within the bundle allocation.

11. Responsibility for ensuring timely use of session bundles remains that of the TherapyPacks bundle holder or, in the case of a minor, their carer/legal guardian.
